Terms & Conditions

1. Acceptance of Terms

By accessing or using the Listing Amplified platform ("Platform"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the Platform. These Terms apply to all users, including Listing Agents and Buyer Agents.

2. Eligibility

You must be an active, licensed real estate agent in the state of California (or the applicable state in which the Platform operates) to use the Platform. By registering, you confirm that your license is current and in good standing with the relevant state real estate regulatory body.

3. Platform Purpose

Listing Amplified is a peer-to-peer listing amplification network. Listing Agents can post property listings for distribution, and Buyer Agents can amplify those listings to their networks via social media and other channels. The Platform is not an MLS, is not affiliated with any MLS, and does not guarantee any transaction or compensation.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to terminate accounts that violate these Terms.

5. Listing Agent Responsibilities

Listing Agents who post properties on the Platform agree to:

• Ensure all listing information is accurate and up to date.
• Have written authorization from the property seller to market the listing.
• Comply with all applicable MLS rules, NAR guidelines, and state real estate laws.
• Remove or update listings promptly upon status changes (sold, under contract, expired).
• Include proper license and brokerage disclosures as required by law.

6. Buyer Agent Responsibilities

Buyer Agents who amplify listings agree to:

• Share content accurately and not alter listing details, images, or agent attribution.
• Include required real estate advertising disclosures when sharing on social media.
• Not use amplified content for personal marketing in a way that misrepresents the listing agent.
• Comply with the social media platform's advertising and fair housing policies.

7. Contribution Points & Rewards

Buyer Agents may earn contribution points for amplifying listings. Points are non-monetary, non-transferable, and have no cash value. Listing Amplified reserves the right to modify or discontinue the points system at any time without liability.

8. Prohibited Conduct

You agree not to:

• Post fraudulent, misleading, or unauthorized listings.
• Use the Platform to spam, harass, or solicit other users.
• Attempt to reverse-engineer, scrape, or disrupt the Platform.
• Violate any applicable law, including fair housing and equal opportunity regulations.
• Impersonate another agent, brokerage, or person.

9. Intellectual Property

All content on the Platform, including logos, design, and code, is the property of Listing Amplified or its licensors. You retain ownership of content you post but grant Listing Amplified a non-exclusive, royalty-free license to display and distribute it within the Platform for the purposes of operating the service.

10. Disclaimer of Warranties

The Platform is provided "as is" without warranties of any kind. Listing Amplified does not guarantee the accuracy of listing data, the availability of the Platform, or any outcome resulting from using the Platform.

11. Limitation of Liability

To the fullest extent permitted by law, Listing Amplified shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of business, data, or revenue.

12. Advertising, MLS & Brokerage Compliance

All content shared through the Platform constitutes real estate advertising under applicable California law and NAR regulations. Users are solely responsible for ensuring their advertising complies with:

• California DRE Regulations: All advertising must include the agent's DRE license number and the brokerage name. Failure to include this information constitutes a violation of California Business & Professions Code §10159.5.
• MLS Rules: If a listing is subject to an MLS agreement, users must comply with all applicable MLS advertising, display, and IDX/VOW policies. Listing Amplified is not an MLS participant and does not guarantee compliance with any specific MLS rules.
• Brokerage Supervision: Listing Amplified does not supervise or manage the activities of any agent or broker. All agents are responsible for obtaining appropriate supervision and approval from their sponsoring broker before posting or amplifying listings.
• Fair Housing: All advertising must comply with the Fair Housing Act and California's fair housing laws. No content may discriminate based on race, color, religion, sex, national origin, disability, familial status, or any other protected class.
• Social Media Disclosures: When sharing listing content on social media platforms, agents must include the required real estate advertising disclosures. Posts must not imply personal representation of the seller unless you are the listing agent.

Listing Amplified reserves the right to remove any listing or content that, in our sole discretion, appears to violate applicable law, MLS rules, or platform policies.

13. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, including for violations of these Terms. Upon termination, your access to the Platform will cease immediately.

14. Changes to Terms

We may update these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. We will make reasonable efforts to notify users of material changes.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in California.
